Information notice on dispute management

    SNCF Voyageurs uses software to track disputes (amicable and contentious procedures).

    Your personal data is used for the management of disputes, for the purposes of preparing, conducting and following up a dispute, either amicably or contentiously, and, where applicable, enforcing the decision rendered.

    The use of your data is based on SNCF Voyageurs' legitimate interest in managing disputes in which its liability (civil and/or criminal) is likely to be sought and/or the liability (civil and/or criminal) of the person concerned is likely to be engaged.

    The data likely to be processed is data relating to :

    • The identification of persons directly or indirectly concerned by the dispute (surname; customary name; first names; gender; date and place of birth; nationality; address, telephone numbers; e-mail address);
    • Information, documents and exhibits collected to establish facts relating to the dispute (in particular, any report; testimony; attestation; formal notice; report of an investigation following a professional alert; images extracted from a video surveillance system; fact-finding form; complaint; medical certificate);
    • Health data (if the dispute concerns personal injury);
    • The characteristics of the dispute (start and end dates, court seized, date of summons, date of hearing, status of proceedings, nature and subject of claims, grievances, arguments, observations and opinions of legal representatives, date of judgment) and comments relating to the description and follow-up of the amicable or contentious proceedings;
    • annotations on the litigation file.

    In addition to annotations, this data may come from legal proceedings (criminal file, conclusions, court rulings, etc.).

    Your data will be kept until the dispute has been settled out of court, or until all legal remedies have been exhausted. At the end of this period, the data is archived in a secure database.

    The provision of certain data, such as the identity of parties, their contact details, legal claims and supporting documents, is legally required in order to take legal action.

    Your data may be communicated:

    • SNCF Voyageurs departments in charge of managing disputes and, to the extent that they are concerned by the dispute, other SNCF Voyageurs departments.
    • SNCF Voyageurs's partners in the follow-up of the dispute: parties to the proceedings, lawyers, courts, court commissioners.

    Your data is hosted in France. It is not transferred outside the European Union.

    No automated decisions are made on the basis of your data.

    Within the limits and conditions authorized by the regulations in force, you may exercise your right to access, rectify, delete and port your personal data, your right to limit and object to the use of your personal data, and your right to define the directives applicable to the retention, deletion and communication of such data after your death.
